How to Pick the Right Attorney for Your Small Business

As a small business owner, hiring the right attorney can make a huge difference—not just when you're dealing with a problem, but also when you're trying to avoid one in the first place. But how do you know if an attorney actually has the skills and experience to help your business? What should you ask before you commit?


Here are a few practical questions to help you screen potential attorneys and find someone who’s the right fit for your business:


  1. Have you worked with other businesses like mine?


You want someone who understands the unique challenges of your industry. If they’ve worked with similar businesses, they’ll be more prepared to spot issues early and offer useful, tailored advice with the experience to back it up.


  1. Can you tell me about problems you’ve helped other business owners solve?


Ask for real examples (with the understanding that lawyers have to maintain certain information about other clients confidential). A good business attorney should be able to explain how they’ve helped other clients deal with contracts, selling their business, negotiating commercial leases or purchases, or resolving disputes without resorting to lawsuits. It’s a great way to understand their approach and get a sense of their experience. 


  1. How do you charge for your services?


Get clear on how billing works—do they charge hourly, offer flat fees, or have monthly plans? Understanding how fees work upfront helps you avoid surprises later.  At RZA Legal, we offer all three of those options depending on what your needs are.


  1. Do you help clients prevent legal problems, or do you mostly help after things go wrong?


Ideally, your business attorney will help you build a strong legal foundation from the start—things like solid contracts, compliance systems, and smart policies—so you can avoid costly issues down the road.   1. How will we communicate, and how quickly do you usually respond?


Make sure their communication style matches yours. If you're someone who needs fast responses or regular check-ins, it’s important to set that expectation early.


  1. Are you comfortable handling contracts, business formation, and issues dealing with business licenses (such as liquor licenses or cannabis business licenses)?


These are common legal needs for small businesses. Look for an attorney who can handle a wide range of issues, so you don’t have to hire someone new every time something comes up.


  1. Can you help make sure my business is following all the right rules?


Whether it’s licensing, local regulations, or tax issues, a good attorney will help keep your business on track and out of trouble.


  1. What’s your approach if I ever have a dispute or get sued?


You’ll want to know if they try to resolve things quickly and efficiently, or if they’re more litigation-focused. Most small businesses benefit from attorneys who try to avoid court when possible.


  1. Do you have any small business clients I could speak to as a reference?


Talking to another small business owner who has worked with the attorney can give you peace of mind and a better sense of what it’s like to work with them.


  1. How do you stay up-to-date with changes in business law?


Laws change all the time, especially for highly regulated businesses. Ask how they keep their knowledge current so they can help you stay compliant.
